This Agreement is entered into between the Client (the "first part") and 4Sure Entertainment Limited (hereinafter referred to as "the Agent") of the second part.
The Agent hereby engages the Client, and the Client agrees to have the Agent present Surprising Singers at the designated venue, on the dates and at the fees specified in the accompanying schedule.
THE FOLLOWING TERMS AND CONDITIONS FORM an integral part of this Agreement.

1. Introduction and Acceptance of Terms
These Terms, together with any documents referred to herein, set out the terms that apply to every booking made with us. By making a booking via our website, telephone, email, or through any associated agents, you (the "Client" or "Customer") agree to be bound by these Terms as displayed on the Website at the time of your booking. If you do not agree with these Terms, please do not proceed with your booking.
2. Interpretation and Definitions
For the purposes of these Terms, the following definitions apply:
- Bookings: The reservation of performers for events made available via our Website, telephone, email, or associated agents.
- Charges: The fees payable by the Customer for the Bookings purchased.
- Customer: The person(s) or entity making a booking.
- Performers: The individuals who will attend and perform at your event.
- Services: The performance services supplied by our Performers in accordance with the Booking.
- Website: https://surprisingsingers.co.uk, including any subdomains or related online properties.
3. Booking, Payments, and Contract Acceptance
- Booking Confirmation:
- A booking is not confirmed until a non-refundable deposit of £400 (or the amount stated on the invoice) has been received.
- If a booking is made within 30 days of the event date, the full balance is required at the time of booking.
- Failure to receive the full balance by the deadline (30 days prior to the event) will result in the booking being deemed cancelled. Payment must be made via the bank account specified in our invoice.
- Contract Acceptance:
- This Agreement is deemed accepted when either:
a) The signed contract is returned within 7 days of receipt, or
b) No written objection is received within 7 days after the exchange of the contract.
- All deposits paid are refundable during a cooling-off period of 14 days after payment. After this period, deposits become non-refundable.
- Additional Booking Information:
- Bookings may be made 24 hours a day, 7 days a week via our enquiry form, email, or phone.
- The Client shall provide all necessary details, including event timelines and specific performance requirements.
- For all bookings, the Client must provide refreshments for the performers at the Venue.
- Future Engagements:
- Any further engagements or additional bookings arising from the current event must be negotiated through our head office rather than directly with individual performers.
4. Charges, Payment Terms, and Additional Costs
- Charges:
- Charges for a booking depend on location, venue size, number of performers required, length of performance, and any special arrangements agreed upon during the quoting phase.
- The agreed fee is inclusive of all expenses, including travel to and from the venue.
- Payment Terms:
- A non-refundable deposit is required to secure your booking.
- The final balance must be paid at least 1 week (or as otherwise agreed) before the event.
- Failure to meet payment deadlines may result in cancellation of the booking without any performance taking place.
- Venue Requirements:
- The Client is responsible for providing mains electricity in the performance area.
- The Client must notify us at least 7 days in advance if there are any allergies or special requirements for guests or performers.
5. Performance Details
- Start Times and Venue Access:
- Performance start times are based on the assumption that Surprising Singers will have access to the performance area before the agreed start time.
- In the event the event runs behind schedule, we reserve the right to commence our performance within 60 minutes of the agreed start time.
- Changes to Venue or Date:
- If the Client requests a change of venue or date, we will make reasonable efforts to accommodate the change.
- Should the new venue or date require additional travel or different performers, a new quote will be issued and any additional fees will be due.
- If we are unable to accommodate the change, the booking may be cancelled subject to our cancellation terms.
- Substitution of Performers:
- In the event a Performer is unable to attend due to illness or unforeseen circumstances, we will arrange a suitable substitute who can deliver a performance of a similar standard.
- A change in the Performer does not constitute a change to your booking, and all fees paid remain non-refundable unless no suitable replacement can be found, in which case a refund will be issued.
6. Cancellation Policy
- Cancellation by the Customer:
- The Customer reserves the right to cancel a Booking. Cancellation fees will be applied as follows:
- If cancellation occurs within 30 days of the event date: 100% of the remaining balance is payable.
- If cancellation occurs between 31 and 90 days from the event date: 50% of the remaining balance is payable.
- A "day" is defined as 24 hours (from 12:00 am to 11:59 pm). The day the cancellation notice is received (via email to admin@surprisingsingers.co.uk) is counted as the first day of the cancellation period.
- All cancellation fees must be paid via bank transfer within 7 days of cancellation. Failure to pay may result in legal action for breach of contract.
- Cancellation by the Service Provider:
- We reserve the right to cancel a booking in the event of Force Majeure (see Section 8).
- If we cancel due to a Force Majeure event and are unable to provide a suitable replacement, a full refund of the deposit and any further charges will be issued within 7 days.
7. Liability, Disclaimer, and Indemnity
- Disclaimer:
- We make reasonable efforts to ensure that all details regarding performances, availability, and timings are accurate and up-to-date. However, we do not guarantee that every aspect will meet your requirements or that there will be no infringement of third-party rights.
- Limitation of Liability:
- We cannot exclude or limit our liability for:
- Death or personal injury caused by our negligence;
- Fraud or fraudulent misrepresentation;
- Liability which cannot be excluded under applicable law (including provisions of the Consumer Protection Act 1987 and the Consumer Rights Act 2015).
- We are responsible only for foreseeable loss or damage caused by a breach of these Terms or our failure to act with reasonable care and skill. Unforeseeable losses are not covered.
- Indemnity:
- The Customer agrees to indemnify and hold harmless 4Sure Entertainment Limited trading as Surprising Singers against any claims arising from breach of these Terms or any misuse of the provided services.
8. Force Majeure
For the purposes of this Agreement, a Force Majeure Event is any circumstance beyond our reasonable control, including (but not limited to) strikes, utility failures, transport breakdowns, acts of God, war, riot, civil commotion, fire, flood, storm, or any other event that prevents us from fulfilling our obligations.
- We shall not be held liable for any delay or failure to perform our obligations as a result of a Force Majeure Event.
- In the event of cancellation due to Force Majeure, we will notify the Customer as soon as possible and make reasonable efforts to arrange a suitable replacement. If no replacement can be found, all deposits and charges paid will be refunded.
9. General Provisions
- Changes to Terms:
- We reserve the right to update or change these Terms at any time. The version displayed on our Website at the time of booking will be deemed accepted by the Customer.
- Severability:
- If any provision of these Terms is found to be invalid, unenforceable, or illegal, the remaining provisions shall continue in full force and effect.
- Non-Waiver:
- Any delay or failure by us to enforce our rights under these Terms shall not constitute a waiver of those rights.
10. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of England. The English Courts shall have exclusive jurisdiction over any legal proceedings arising in connection with these Terms.
